In Kentucky, the probate court will name or appoint an individual as a personal representative of a deceased person’s estate. This personal representative can pursue a wrongful death action against the person or company whose negligence or wrongful act caused the loss of the decedent’s life.

Wrongful death also causes serious harm to the family. The loss of a loved one will cause a loss of love, affection, aid, companionship, and services to the surviving spouse and children. Parents who have lost their minor child due to the negligent and wrongful acts of another also experience the loss of love, affection, aid, companionship, and services of their child.

Damages for all these losses are recoverable. In Kentucky damages related to burial and funeral expenses are typically paid to the deceased estate while all other damages are paid to the surviving family members. Usually, damages will be distributed to surviving family members in this order:

  • If there is a surviving spouse but no surviving children, all damages will go to a spouse
  • If there are a surviving spouse and surviving children, all damages will be equally split between the spouse and children
  • If there is no surviving spouse but surviving children damages will be awarded to the children
  • If there are no surviving spouse or children damages will be awarded to the parents of the deceased
  • In cases where there is no surviving spouse, children, or parents damages will be awarded to any individuals listed in the deceased's will

Kentucky law allows parents to pursue damages for unborn children if they are considered a "viable fetus." This means the child is able to survive outside of the womb as well as inside of it. This area of the law is a bit controversial as not all of it is clearly defined.
